DhuMall Affiliate Program Terms & Conditions

This DhuMall Affiliate Program Terms and Conditions will govern your participation in the DhuMall Affiliate Program.

Preface
DhuMall Affiliate Program offers eligible affiliates the opportunity to earn Rewards on qualifying sales and business transactions that originate from Your links to DhuMall and from Your registered customers in DhuMall. The terms and conditions here explain your rights and responsibilities when participating in DhuMall Affiliate Program.

DhuMall Affiliate Program offers eligible entities or individuals (collectively, “Affiliates” each an “Affiliate”, “You” or “Your”), the opportunity to earn Rewards on qualifying sales and business transactions that originate from Your links to DhuMall (“Affiliate Link”) on an Affiliate’s Authorized Channel, and from your registered customers in DhuMall. The terms and conditions here explain your rights and responsibilities when participating in DhuMall Affiliate Program. “Authorized Channels” means social media pages, websites, blogs, emails, online advertisements and such other communications owned and operated by you and such media and channels that have been accepted and approved by Dhunicorn for participation in the DhuMall Affiliate Program.

PLEASE READ AND UNDERSTAND THE DHUMALL AFFILIATE PROGRAM TERMS AND CONDITIONS (HEREAFTER REFERRED TO AS “TERMS”) CAREFULLY. THE DHUMALL AFFILIATE PROGRAM (HEREAFTER REFERRED TO AS “AFFILIATE PROGRAM” OR “PROGRAM”) IS AN INTERNET MARKETING PROGRAM ESTABLISHED BY DHUNICORN SDN. BHD. (HEREAFTER REFERRED TO AS “DHUNICORN”, “COMPANY”, “US”, “WE” OR “OUR”). THESE TERMS IS BETWEEN US, DHUNICORN AND YOU; AN INDIVIDUAL PARTICIPANT OF THE PROGRAM OR ON BEHALF OF AN ENTITY TO PARTICIPATE IN THE PROGRAM. IF YOU ARE REPRESENTING AN ENTITY, YOU ARE CONSIDERED TO HAVE ACCEPTED THESE TERMS ON BEHALF OF THAT ENTITY. BY CHECKING THE BOX IN THE REGISTRATION FORM, YOU ACKNOWLEDGE AND AGREE TO THE TERMS AND CONDITIONS STATED HEREIN WITH THE EFFECTIVE DATE IS THE DATE ON WHICH YOU CHECK THE BOX.

THESE TERMS ARE EFFECTIVE BETWEEN US AND THE AFFILIATE FOR AS LONG AS THE AFFILIATE CONTINUE TO REMAIN IN THE PROGRAM. DHUNICORN RESERVE THE RIGHTS TO ADD, CHANGE, MODIFY AND/OR REVISE THE TERMS WITHOUT ANY NOTICE, AT ANY TIME. YOU ACKNOWLEDGE AND AGREE THAT IT IS YOUR RESPONSIBILITY TO REVIEW THESE TERMS PERIODICALLY TO FAMILIARIZE YOURSELF WITH ANY ADDITIONS, REVISIONS, OR MODIFICATIONS THAT WE MAY HAVE MADE TO THESE TERMS. YOUR CONTINUED PARTICIPATION IN THE PROGRAM AFTER SUCH ADDITIONS, REVISIONS, OR MODIFICATIONS WILL CONSTITUTE YOUR ACKNOWLEDGMENT AND AGREEMENT OF THE MODIFIED TERMS AND CONDITIONS. IF YOU DISAGREE WITH THE ADDITIONS, REVISIONS, OR MODIFICATIONS THAT WE MAY HAVE MADE TO THESE TERMS, YOU MUST TERMINATE YOUR ACCOUNT AND LEAVE THE PROGRAM IMMEDIATELY.

You also acknowledge and agree that Dhunicorn may use the Affiliate Program, including your Affiliate Link, as part of Dhunicorn's Offsite Ads program.

Dhunicorn reserves the right to remove Affiliates from the DhuMall Affiliate Program and refuse service, for any reason, at any time. Participation in the DhuMall Affiliate Program may be limited to Affiliates located in certain countries and is void where prohibited by law.

Eligibility and Enrolment in DhuMall Affiliate Program
DhuMall Affiliate Program is an internet marketing program where the Affiliate generates traffic via Qualifying Links placed in Affiliate’s Authorized Channels or social media page or e-mail to link to the Dhunicorn online store DhuMall, located at www.dhumall.com (hereafter referred to as “DhuMall”). This Program is a voluntary participation program and You can terminate Your participation at any time.

Prospective affiliates must apply to be a party of the DhuMall Affiliate Program based on their country of residence and be approved by Us, in Our sole discretion, in order to gain access to the DhuMall Affiliate Program. We reserve the right to approve or reject any application to join the DhuMall Affiliate Program for any reason whatsoever.

Sales from Affiliate Link will track regardless of where in the world the sale took place. Affiliate is evaluated based on criteria such as type of site, site quality, site content, variety of site content and items promoted, brand identity, and alignment with our values. Affiliate may be asked to share additional information about any of the listed criteria.
1. Conditions for participation in the DhuMall Affiliate Program:
  - An individual must be at least 18 years old on the date of application to join the program, either as an individual participant or to represent an entity;
  - You own and operate social media pages, websites, blogs, emails and such other communications of which the media and channels must be approved separately by us. You must provide accurate link of your web site(s) or social media page in the application and subject to 1.2 below;
  - Have an appropriate amount and type of content on the Authorised Channels, as determined by us, in our sole discretion;
  - You are not a supplier, vendor or provider of goods or services to Dhunicorn.
  - An individual that has registered a DhuMall Affiliate Account and has agreed with the DhuMall Affiliate Program Terms & Conditions, and has been approved by Dhunicorn to participate and is participating in the DhuMall Affiliate Program;
  - An entity that has registered a DhuMall Affiliate account and has agreed with the DhuMall Affiliate Program Terms & Conditions, and has been approved by Dhunicorn to participate and is participating in the DhuMall Affiliate Program. An entity is a juridical person that forms a corporation, a company, a trust, a government agency or a private agency, as recognized by law.
2. The following types of social media pages, websites, blogs, emails, and such other communications, media and channels are prohibited from participating in the DhuMall Affiliate Program without prior written permission from Dhunicorn:
  - Sites that are password-protected or otherwise require credentials to see content;
  - Sites with content related to sexual, religious, political or other sensitive matters, or otherwise have content that violates Dhunicorn's Policies or are otherwise inconsistent with Dhunicorn's brand.
  - Sites that are promoting violence and/or contains violent materials;
  - Sites that are promoting defamatory acts and/or contains libellous materials;
  - Sites that are practicing and/or contains discriminating material based on but not limited to race, gender, religion, nationality, disability, sexual orientation or age;
  - Sites that are contain information which compromise state and/or national security;
  - Sites that are involve and/or promote illegal goods, services or activities;
  - Sites contain content that infringe upon the lawful rights and interests or a third party, and/or contain insults or slanders of a third party;
  - Sites contain content that is prohibited by laws or administrative regulations;
  - Sites that are installing software to divert visitors and/or Rewards of other affiliates to your account.
RESPONSIBILITIES AND WARRANTIES OF AFFILIATE
All clauses stated in this section falls under the Affiliate responsibility:
1. You must provide accurate, truthful, correct, and up-to-date information about Yourself (such as but not limited to contact details, payment and tax information) and Your Program registered web site(s) social media page or e-mail address. Your name must be consistent with the payment details at the time of registration. Dhunicorn has the right to confirm or verify the truth and accuracy of your registration and account information at any time. If You deactivate Your e-mail that is associated with the Affiliate Program, You must immediately inform Us of the new e-mail. Dhunicorn may send e-mail relating to the Affiliate Program and the Terms to the deactivated e-mail. You hereby shall be deemed to have received e-mail sent to that deactivated e-mail address. Should you decide to deactivate Your current Affiliate Program registered web site, create a new site to replace the current one or added new website(s) to the list of Your Program registered site, you must inform Dhunicorn immediately of the changes.
2. You must apply to be enrolled in DhuMall Affiliate Program directly through the DhuMall Affiliate Program platform, operated by Dhunicorn.
3. The confidentiality of the account username and password and restrictive access to the account is under Your responsibility. You also agree to bear the responsibility for activities that happen under Your account whether or not authorized by You. Should You become aware of breach of security of Your account including but not limited to loss, theft, or unauthorized disclosure of Your username and password, You must promptly notify Us at affiliate@dhumall.com. We reserve the right to terminate Your account if any fraudulent, abusive or illegal activity is discovered. Such cases will be referred to the appropriate law enforcement agencies.
4. The Authorized Channels or social media page maintenance, development, operation, including technical operation, and management of material that appear in or on the Authorized Channels.
5. Ensure the technical operation and its related equipment in displaying the program links and content are in compliance with this agreement and any other agreement which include restriction and requirement between other individual and/or entity that host(s) Your Authorized Channels and You.
6. Ensure the accuracy, completeness and appropriateness of materials and contents posted on the Authorized Channels that include Dhunicorn product descriptions, product-related materials and any information You include in or associate with the program links.
7. Ensure no infringement, violation, misappropriation of rights either of Dhunicorn or any individual or entity which include but not limited to copyrights, trademarks, privacy, publicity or other intellectual property or propriety rights.
8. You hereby agree to defend, indemnify, and hold Us, Our affiliates and licensors, and Our and their respective employees, officers, directors, and representatives, harmless from and against all claims, damages, losses, liabilities, costs, and expenses. Dhunicorn shall have no liability for the aforementioned matters in Clauses 2.4 – 2.7 for any of Your visitors claims relating to these matters:
  - i. Your Authorized Channels (development, design) or any materials (production, advertising, promotion, or marketing) or the combination of Your Authorized Channels and the materials with other applications, content, or processes that appear on and/or within the site;
  - ii. Use of any resources, whether or not You receive authorization for such use, that violates this Terms and Conditions or violates applicable law;
  - iii. Violation of any of the Terms by You; or
  - iv. Negligence or wilful misconduct by You or Your employees.
9. You must describe all promotional methods used and will be used accurately. If requested by Us, You may even need to provide additional information regarding the promotional methods. Dhunicorn reserves the right to accept or to refuse the promotional method. If We decide the promotional methods as ‘Special Promotion’, you need additional approval from Dhunicorn to run such Special Promotion.
10. You hereby agree that the information contain in Your web site(s) is solely owned by You, as an individual participant, or provided by You with the express authority of the entity You represent. The information must not infringe upon any other individual's or organization's rights.
11. You hereby consent to Dhunicorn continuous monitoring either through investigating and/or crawling Your site or social media page or demand carbon copy of program related e-mail that You sent out to verify Your compliance with these Terms. You hereby consent to Dhunicorn recording, using, and disclosing information about Your Authorized Channels and its visitors obtain from monitoring and via qualifying links.
Dhunicorn may suspend your account and/or withhold Rewards if it determines you are in violation of any of the conditions contained in this Section 2. Should a termination of Your account and/or these Terms happen, you are to remove any trademarks, banners and any other material referencing Dhunicorn or DhuMall, immediately or cease sending e-mail promoting Dhunicorn and its products.
Rewards, Qualifying Sales and Payment
As an Affiliate, you are eligible to receive Rewards for qualifying sales. Rewards are determined on a case-by-case basis and may vary based on a variety of factors, such as type of products.
The Rewards, could be in the form of commissions, bonuses, or other financial and monetary gain are not stated in these Terms. The information is available in the Affiliate Wealth Plan and FAQ section from DhuMall.
1. Affiliate will receive Rewards from successful business transaction made via the Affiliate Link, tracking cookies, personal referral and/or Creative Assets from the Authorized Channels. The Rewards may change from time-to-time by Dhunicorn listed in these Terms.
2. Qualifying business transactions are sales and business deals made on DhuMall by customers referred by affiliates. Affiliate Link, including URLs and banners or other creative assets (collectively, the “Creative Assets”), can be found on the DhuMall Affiliate Program platform. To receive Rewards, Affiliates must (a) use only Affiliate Link provided by Dhunicorn, (b) only use Authorized Channels, and (c) not alter any of the text links made available through the DhuMall Affiliate Program platform. Affiliates are also requested not to hardcode Affiliate Link into their sites.
3. Customers who made a purchase in DhuMall will be registered as long-term customers of the affiliate. The Affiliate who sign up the customer will gain rewards from all future sales transaction made by the customers directly through DhuMall. If the registered customer clicks multiple Affiliate Link in the future, another affiliate who owns the last Affiliate Link to be clicked prior to a qualifying sale will receive the Rewards. However, all future rewards from business transactions made by the customers directly in DhuMall will again be given back to the initial affiliate who sign up the customer.
4. Rewards are not paid on sales that are cancelled, refunded, returned, or on any transaction that results in a chargeback. Rewards are subject to review and other limitations for fraudulent activity. Dhunicorn reserves the right to withhold Rewards for any legitimate reason. You are solely responsible for any taxes that may be due in connection with your participation in DhuMall Affiliate Program.
5. Dhunicorn, in its sole discretion may with or without notice change, suspend or discontinue an Affiliate Link or remove, alter, or modify any graphic or banner ad submitted by Dhunicorn through the DhuMall Affiliate Program platform. Affiliate agrees to promptly implement any request from Dhunicorn to remove, alter or modify any Affiliate Link, graphic, or banner ad submitted by Dhunicorn.
6. You can choose method of payment from the following options:
  - i. Via wire transferred which is only offered from monthly Rewards payment exceeding US$100.
  - ii. Use your Rewards to pay for the products and services available at DhuMall.
7. In conjunction with 3.6 above, Rewards will only be paid to the Affiliate’s bank account. It is Your responsibility to provide Us a valid bank account with the necessary details required by the financial institutions.
8. Dhunicorn reserves the right to deduct Rewards that is accredited to Your account in the event of Void. Should Your account balance less than the Void, We will deduct it from Your accredited future Rewards.
9. Excluding Qualifying Purchase, Affiliate will not be paid Rewards on without limitation, any of the following:
  - i. Failure of tracking any product purchase due to the Affiliate Link from the Authorized Channels to DhuMall are not properly and/or wrongly formatted;
  - ii. Any product purchased after termination of these Terms;
  - iii. Any product purchased by a customer who is referred to DhuMall through a Paid Search. Refer section 4.3 for complete understanding.
Program Restrictions
Affiliates that violate any of the following program restrictions may be suspended or removed from the DhuMall Affiliate Program and may not receive Rewards, in Dhunicorn’s sole discretion:
1. Social Media and Sharing
  You may only post Affiliate Link on Authorized Channels operate in line with Your website URL, such as YouTube, WhatsApp, Instagram, Facebook, or Twitter. When posting content, it is your responsibility to follow and abide by each Social Media platform’s terms and conditions, including any policies on affiliate’s links. You may share Affiliate Link with its email subscribers. In addition, You may only use the creative materials and Affiliate Link provided by Dhunicorn and only in the Authorized Channels which do not include closed or private group pages.
2. Use of Promotion/ Voucher Codes
  You may only promote approved Dhunicorn Promotion/Voucher codes that link directly to the applicable DhuMall and are provided through the DhuMall Affiliate Program platform. Any expiration dates should be clearly and prominently displayed next to the Promotion/Voucher codes; codes should be removed or explicitly marked as expired on or just prior to the expiration dates. Affiliates displaying expired codes without marking them as being expired may be suspended from the DhuMall Affiliate Program.
3. Paid Search
  In connection with the DhuMall Affiliate Program, You agree that You will not bid on any keywords containing DhuMall trademarks for internet search advertising, search engine optimisation, or for any other purpose. Affiliates may not purchase domain names that have variations from DhuMall’s domain or misspellings in them which are solely intended to direct traffic away from the DhuMall, or purchase any domains containing DhuMall Trademarks, including variations or misspellings.
  Affiliates must comply with the following conditions, including in connection with any advertising on any ad platform (e.g. search engines, content networks, and social networking sites):
  - a. Affiliates are not permitted to bid or appear on searches, including extended or hybrid searches, that include the term (including misspellings or variations) “DhuMall”
  - b. Affiliates are not permitted to use DhuMall’s trademarks in any paid search activity, including ad text, copy or display URLs;
  - c. Affiliates are not permitted to send traffic through automatic redirects on a website page;
  - d. Affiliates are not permitted to use the DhuMall name (including misspellings and variations) as a sub-domain or sub-folder;
  - e. Affiliates are not permitted to use DhuMall trademarks, or any variation thereof, in hidden text or source code, including within its site’s domain or sub-domain;
  - f. Affiliates are not permitted to use DhuMall's brand in a manner that suggests an affiliation, association, or brand partnership, or in a manner otherwise inconsistent with DhuMall's Trademark Policy;
  - g. Affiliates are not permitted to engineer its site in such a manner that it pulls internet traffic away from DhuMall, including without limitation, "keyword stuffing" such as using terms in hidden or live text that is meant to attract search engine spiders in order to determine higher relevance or rank than the DhuMall; and
  - h. Affiliates must comply with any guidelines imposed by Dhunicorn to you from time to time regarding the Dhunicorn standards which includes the avoidance of unauthorized claims or unsubstantiated claims.
4. Unsolicited Advertising
  
  Affiliates are strictly prohibited from engaging in unsolicited advertising, printed or electronic, written or oral. The example of unsolicited advertising is but is not limited to spam, telemarketing, and junk mail. You are also strictly prohibited from using e-mail extractor to obtain e-mail addresses from Dhunicorn web sites and e-mail. Dhunicorn has the right to collect, withhold, or cancel any and all compensation related to the content You advertise via unsolicited advertising.
5. You are STRICTLY PROHIBITED from issuing or making any public statement including but not limited to, press releases, advertisement or Solicited Advertising materials on Your web site or any other site regarding:
  - i. DhuMall Affiliate Program Terms and Conditions;
  - ii. DhuMall name or referencing DhuMall's products; and/or
  - iii. Endorsement by Dhunicorn or DhuMall of You, either as suggestion or implication without the prior written approval of Dhunicorn, which Dhunicorn may withhold in its sole and non-restricted discretion.
6. As an Affiliate you may receive or given access to sensitive, confidential, and/or proprietary information of the Dhunicorn (refer Section 6.6), You are STRICTLY PROHIBITED from:
  - a. disclosing the any means of information as stated to any person or entity; or
  - b. using the information either for your own benefit or the benefit of any other individual or entity, without the express prior written consent of Dhunicorn. You are not to use the information for the purpose of soliciting, or to permit any others to solicit, or to subscribe to any other services or promote the sale of any product which competes, either directly or indirectly, with Dhunicorn.
7. Design the web site(s) to resemble or disguise as DhuMall online store or web site or create fake Dhunicorn or DhuMall social media page or send e-mail pretending from Dhunicorn.
Compliance and Disclosures

Depending on where You are located, You may be subject to varying regulations relating to the operation, marketing, and advertising of Your site. As an Affiliate, it’s Your responsibility to know and follow any applicable regulations that apply to Your site. Dhunicorn is unable to provide legal advice; We urge You to speak to a legal expert if You are unsure of Your obligations or have specific questions.
1. Compliance with Laws
  Affiliates must comply with all applicable international, federal, state, and local laws as it relates to operation of its website and any organic or paid advertising of its website. You agree that You are responsible for all personal information that you collect from users of Your site and that you must obtain valid consent (if applicable) from end users to collect, use or disclose this information as required by applicable law.
  
  Affiliates must ensure all e-mail marketing complies with applicable laws and regulations, including without limitation and any other applicable anti-spam or related regulations, laws, or industry best practices, related to the dissemination of commercial e-mails in their country. E-mails must not state or imply that the email is being sent by, or on behalf of, Dhunicorn, or Dhunicorn sellers.
2. Consumer Disclosures As an Affiliate, You must comply with the laws, rules, regulations and guidelines in Your country, as well as the policies of each social media platform, concerning Affiliate’s disclosure of a material connection with Dhunicorn.
  
  In any and all social media outlets or other digital properties in which an Affiliate communicates about Dhunicorn or products sold on DhuMall, or in any other advertising, the Affiliate must clearly and conspicuously disclose their relationship and their material connection (meaning the Affiliate receives payment of Rewards or other compensation) with Dhunicorn. For example, an Affiliate could use the identifier “ad” or “advert” before each Affiliate Link (or any local language equivalent); ensure that each such disclosure is prominently placed in close proximity to the communication about Dhunicorn or products sold on DhuMall; not make any false, misleading or deceptive statements about Dhunicorn, or products sold on DhuMall; ensure that any opinion or personal endorsement given about any Dhunicorn products is honestly and genuinely held; and not make unsupported or untruthful product performance or attribute claims concerning products sold on DhuMall or any claims about product performance or attributes without personal knowledge or substantiation (i.e. proof) of the same.
Miscellaneous
1. Right to Audit, Suspension & Termination
  
  Dhunicorn has the right to audit You, Your sites, or activities related to your site, including compliance with these Terms, in relation to Your participation in the DhuMall Affiliate Program. If Dhunicorn believes that You have breached the Terms or that You have engaged in fraudulent activity, it may take any steps it deems appropriate, such as: (i) issue a warning; (ii) conduct an investigation; (iii) suspend Your account; (iv) terminate Your account from the DhuMall Affiliate Program or (v) withhold Rewards payments.
2. Indemnification
  
  You agree to indemnify, defend, and hold harmless Dhunicorn, its affiliates and subsidiaries, and each of their respective directors, members, officers, employees, representatives, agents, successors and assigns from and against any and all damages, judgments, settlements, awards, penalties, and costs (including reasonable lawyers’ fees) in relation to a third party claim arising from or related to: (i) Your negligence, wilful misconduct or acts or omissions; (ii) Your violation of applicable laws or regulations or applicable codes of practice; (iii) Your breach or other non-compliance with the terms of this Affiliate Policy or (iv) Your Authorised Channels and other content.
3. Limitation of Liability
  
  Nothing in this Policy, including this Section 6.3, shall attempt to exclude or limit liability that can't be excluded or limited under applicable law including without limit, death or personal injury caused by a party’s negligence, or for fraudulent conduct. Subject to this, and to the maximum extent permitted under applicable law, Dhunicorn will not be liable for indirect, special or consequential damages arising in connection with this Terms and the DhuMall Affiliate Program.
4. Representations and Warranties
  
  Dhunicorn makes no representations or warranties to You, including, but not limited to, any implied warranties of merchantability for a particular purpose. Dhunicorn makes no express or implied warranties or representations with respect to the DhuMall Affiliate Program or any products or services sold through the DhuMall Affiliate Program, or as to any Rewards that you may earn through the DhuMall Affiliate Program, or that any DhuMall site, DhuMall Affiliate Program platform or network will be uninterrupted or error-free, and Dhunicorn will not be responsible for consequences or any interruptions or errors. Dhunicorn shall not be liable for any damages either special or incidental or consequential arising out of and/or related to these Terms, and/or Dhunicorn's performance or failure to perform any of its obligations as stated here.
5. Successors and Assigns
  
  This DhuMall Affiliate Program shall be binding upon and inure to the benefit of the parties hereto and their respective successors and assigns and shall also inure to the benefit of the parties and their respective successors and assigns.
6. Privacy and Confidentiality
  1. In connection with the DhuMall Affiliate Program and these Terms, Dhunicorn may disclose to You and/or You may receive or given access to sensitive, confidential, and/or proprietary information of Dhunicorn which may include but not limited to:
    - i. the identities of and/or contact information for other Affiliates, brokers, customers, distributors or vendors of Dhunicorn;
    - ii. physical data, sales data, technical data, and data security information;
    - iii. Business information such as business processes, methods, or marketing strategies. Except as required to perform Your obligations under and in accordance with the terms of these Terms.
    You hereby acknowledge and agree that any breach or threat to breach of this particular part of these Terms may cause immediate and irreparable harm and/or damages to Dhunicorn which would not be adequately and fully compensated by money. It is Dhunicorn rights to seek injunctive relief, specific performance, and/or other equitable relief as a remedy for any such breach or anticipated breach without the necessity of posting a bond or other security. Any such relief shall be in addition to and not in lieu of any appropriate relief in the way of monetary damages.
  2. You are not to offer and Dhunicorn WILL NOT accept any ideas or information You consider to be confidential and/or proprietary. The types of information Dhunicorn accept are: Affiliate personal information, Affiliate non-personal information (the type of browser, the type of electronic devices and technical information, means of connection to Our online store, i.e. the operating system and the Internet service providers’ used and other similar information). If You submit any suggestions, submissions, comments, ideas, concepts, know-how, techniques material or feedback to Dhunicorn, it shall be deemed to be non-confidential and non-proprietary and Dhunicorn shall have no obligation for such submission, unless otherwise expressly agreed in writing by Dhunicorn. Such submission is also free and you are not to demand any compensation from Dhunicorn. Your Submissions should never be unlawful, threatening, abusive, false, libellous, defamatory, obscene, pornographic, profane, or otherwise infringing or objectionable content or material of any kind. You hereby grant Dhunicorn a worldwide, perpetual, non-exclusive, fully-paid, royalty-free, transferable right and license (with right to sublicense, to reproduce, publicly display, distribute, and perform, transmit, edit, modify, create derivatives works of, publish, sell, commercially exploit, use, and disclose the submissions for any purpose and in all forms and all media at any time). At any time, You are and shall remain solely responsible for the content of submissions You make. You are also to acknowledge that Dhunicorn is not obligated to respond to or use the submitted information.
7. Governing Law, Jurisdiction, and Venue
  
  Our DhuMall online store and these Terms are controlled by Dhunicorn and governed by the laws of the Malaysia. By accessing to DhuMall, You agree to obey the statutes and laws of Malaysia all matters relating to the use of these web sites and the purchase of any products or services through this site, dhumall.com. Furthermore, any action relating to these Terms or your participation in the DhuMall Affiliate Program must be brought only in the federal or state courts located in Malaysia. You hereby agree to personal jurisdiction by such courts, and waive any jurisdictional, venue, or forum non convenience to such courts.
8. Contact & Communications
  
  Dhunicorn may contact Affiliates directly with essential program updates and offers. If You no longer consent to be contacted or wish to leave the program, You must send an email to affiliate@dhumall.com. Even if You opt-out of receiving promotional emails, You may still receive transactional emails related to Your account or participation in the program.
  
  Any exceptions to these Terms are effective only if expressly made in writing by Dhunicorn.
